prepared?
The Disability Discrimination Act 1995 has been amended by the Disability Discrimination
Act 2005 to place a new duty on all public sector authorities to promote
disability equality. Commentators are suggesting that this will have
a significant impact on the way in which all public services are run
and will have a profound impact on improving the lives of disabled people.
It is part of a general breed of new legislation that aims to ensure
that all public bodies place equality issues at the forefront of policies
and how they carry out their functions. Similar legislation was passed
in relation to the Race Relations Act 1976.
The new legislation will mean that public sector bodies will
have a duty to promote disability equality in all aspects of their work.
The police, health services, schools, local authorities, NHS Trusts and
central government should prepare for change now as the new duty comes
into effect December 2006.
Coupled with this development there are a number of changes
brought in by statutory changes in 2004 of which you must be aware. Consequently,
recent case such as Meikle, Archbold and Randall are forcing employers
to re-assess their responsibilities to make reasonable adjustments.
